Terms of Service of fit.expert

Effective date: 5 May 2026.

§ 1. General provisions

1. These Terms of Service set out the rules for using the fit.expert service available at www.fit.expert and its associated mobile and web applications (the "Service").
2. The operator of the Service is BADRED Sp. z o.o. with registered office in Kraków, ul. Zamknięta 10/1.5, 30-554 Kraków, Poland, registered in the Polish entrepreneurs registry (KRS) under number 0000751115, tax ID (NIP) 6793175038, statistical ID (REGON) 381442932, share capital PLN 5,000.00 (the "Operator").
3. Use of the Service constitutes full acceptance of these Terms.

§ 2. Definitions

1. User – a natural person, legal entity or organisational unit using the Service.
2. Trainer – a User providing training services through the Service.
3. Client– a User using a Trainer's services through the Service.
4. Subscription– paid recurring access to the Service's functionality.
5. Stripe – the payment operator handling transactions within the Service.

§ 3. Scope of services

1. The Service enables Trainers to manage availability calendars, clients, training packages and online payments.
2. Clients can book training sessions, purchase packages and communicate with their Trainer.
3. The Operator does not provide training services — it acts solely as a technology intermediary between Trainer and Client.

§ 4. User account

1. Creating an account requires providing accurate information and accepting these Terms and the Privacy Policy.
2. The User is required to keep their login credentials confidential.
3. The Operator reserves the right to suspend an account in case of breach of these Terms.

§ 5. Subscription and fees

1. Use of Trainer functionality requires an active Subscription priced at 60 PLN per month (unless a promotion or trial period applies).
2. New Trainers receive a 14-day free trial period.
3. Subscription billing is handled by Stripe; the fee is charged recurrently until cancellation.
4. The User may cancel the Subscription at any time from the account settings. Cancellation prevents renewal at the end of the paid period.
5. The Operator charges a commission on online transactions made by Clients to Trainers; the current commission rate is shown in the Trainer panel.

§ 6. Payments

1. Online payments are processed by Stripe, Inc. (Connect Express). Trainers using online payments enter into a separate agreement with Stripe.
2. Funds from online payments are transferred to the Trainer's account according to Stripe's schedule.
3. Refunds are handled according to the Trainer's cancellation policy; where required by law, the Operator may initiate a refund.

§ 7. Liability

1. The Operator is not liable for the quality, safety or outcomes of training services provided by Trainers.
2. The Operator strives to ensure uninterrupted operation of the Service but does not guarantee full availability and reserves the right to scheduled maintenance.
3. The Operator's liability is limited to the amount of fees paid by the User during the last 12 months.

§ 8. Complaints

1. Complaints regarding the Service should be sent to: contact@fit.expert.
2. The Operator handles complaints within 14 business days from the date of submission.

§ 9. Personal data

The processing of personal data is governed by the Privacy Policy.

§ 10. Termination

1. The User may delete their account at any time from the settings.
2. The Operator may terminate the service in case of material breach of these Terms.

§ 11. Changes to the Terms

The Operator reserves the right to amend these Terms. Users will be notified of any changes by email or through a notice in the Service at least 14 days in advance.

§ 12. Final provisions

1. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on the provision of electronic services, and the GDPR.
2. Any disputes will be resolved by the court competent for the Operator's seat.
